At 5IVE Star Catering, we understand the importance of exceptional food and service in making your special events truly unforgettable. We are a professional catering company dedicated to providing top-notch culinary experiences for parties, events, and gatherings of all sizes.

To ensure a smooth and successful partnership, we kindly request that you review and agree to the following terms and conditions:

 

1. Acceptance of Terms

These Terms & Conditions ("Terms") govern the provision of catering services by [5IVE STAR LLC] ("we," "us," or "our") to you, the client ("you" or "your"). By placing an order for catering services with us, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not place an order.  

 

2. Orders & Reservations

  • Orders: All catering orders must be placed in writing (email, phone, or online order form) and confirmed by us in writing.
  • Reservations: For events requiring on-site service (e.g., buffet, plated service), reservations must be made in advance, subject to availability.
  • Order Changes: Any changes to your order must be made in writing and confirmed by us in writing as soon as possible. Changes may be subject to availability and may incur additional charges.

3. Pricing & Payment

  • Pricing: Prices are subject to change without notice.
  • Payment:
    • A deposit of 50% of the total order amount is required at the time of booking.
    • Full payment is due 14 days prior to the event date.
    • Accepted payment methods: [List accepted payment methods, e.g., credit card, debit card, cash only
    • Late payments may be subject to a late fee of 3% per day unless otherwise arranged.

4. Delivery & Set-up

  • Delivery: Delivery charges may apply depending on the location and distance.
  • Set-up: On-site set-up and service fees may apply depending on the type of service required.
  • Delivery Time: We will make every effort to deliver your order on time, but we are not responsible for delays caused by unforeseen circumstances (e.g., traffic, weather).

5. Cancellation & Refunds

  • Cancellation: If you need to cancel your order, please notify us in writing as soon as possible.
  • Cancellation Fees:
      • Within 7 days of the event: 85% of the total order amount will be refunded.
      • Within 3 days of the event:  65% of the total order amount will be refunded.
      • Less than 3 days notice: No refund.
  • Refunds: Refunds will be processed within 5-7 business days after the cancellation is processed. Please note that no refund will be issued on items that were already purchased for your event.

6. Liability

  • Food Safety: We take all necessary precautions to ensure the safety and quality of our food. However, we are not responsible for any foodborne illnesses or allergic reactions that may occur.
  • Damage & Loss: We are not responsible for any damage or loss to your property during delivery or set-up.
  • Force Majeure: We are not liable for any delays or cancellations due to unforeseen circumstances beyond our control, such as natural disasters, strikes, or government regulations.

7. Indemnification

You agree to indemnify and hold us harmless from any and all claims, losses, damages, liabilities, costs, and expenses (including attorney's fees) arising out of or related to your use of our services, your breach of these Terms, or your violation of any applicable law.  

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California.

9. Modifications

We reserve the right to modify these Terms at any time without prior notice. The most current version of these Terms will be posted on our website.

10. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.  

11. Entire Agreement

These Terms constitute the entire agreement between you and us with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
